Partner Daniel Devinney, Esq. of Sarno da Costa D’Aniello Maceri Webb LLC secured a $1,400,000.00 settlement on behalf of the family of a 25-year-old man who died as a result of undiagnosed and untreated bowel ischemia, which was reached before opening arguments at trial.

Case Background

The Plaintiff Decedent presented to the emergency room with complaints of 10/10 abdominal pain. A CT scan was performed and was read as showing enteritis. Over the course of the following twelve hours, his condition worsened, ultimately requiring admission to the Intensive Care Unit. A surgical consult was obtained, but surgery was not performed immediately.

Before surgery could be completed, the Decedent suffered a cardiac arrest. He was revived, and surgery ultimately revealed eleven feet of dead bowel. Despite these efforts, the Decedent was unable to recover and passed away.

The Allegations

Plaintiff alleged that the six defendant physicians who cared for the Decedent during his admission failed to timely diagnose, and treat his developing bowel ischemia.

Resolution

The matter proceeded to the point of trial, with the settlement ultimately reached before opening arguments. Rather than pursuing a global settlement, the resolution was achieved by strategically settling out with the individual defendants. The Decedent was not married and had no children. He is survived by his parents.
