Beginning at 10:45 a.m., Jerry’s discussion, titled “Smart Use of Smart Phones and Ethical Implications,” will focus on the increasing use of smart phones as means to acquire evidence in divorce proceedings. He will address different types of electronic data, apps, and spyware and the ways they come up as evidence in a divorce case.
You can also expect Jerry to talk about various ethical implications surrounding the use of smart phones, apps and spyware in divorce. As a few examples, Jerry will address the attorney-client privilege and how that relates to evidence acquired from smart phones, the danger of spoliation of evidence on smart phones (e.g. deleting information), and the wiretap statute.
Paul will be lecturing at the Medical Malpractice seminar about “proving emotional distress damages” in medical malpractice cases beginning at 10:30 a.m. Paul will provide pre-trial and trial techniques and strategies to maximize emotional distress damages for clients.
In the personal injury seminar room on the first floor, Dan will be speaking as a member of the NJAJ rising stars panel between 8:30 a.m. and 10:00 a.m. Dan will also be speaking at the New Lawyer’s Section’s presentation on “How to Become a Successful Attorney” at 11:15 a.m. to 12:00 p.m. Specifically, Dan will be discussing strategies for preparing your witnesses for trial, including clients, fact witnesses, treating physicians, and expert witnesses.
