Paul da Costa & Daniel Devinney Obtain $950,000 Settlement
Sarno da Costa D’Aniello Maceri LLC Partners, Paul M. da Costa and Daniel Devinney, recently obtained a $950,000 settlement in a failure to timely diagnose and treat cancer medical malpractice case. In particular, Plaintiff’s decedent had passed away due to a delayed diagnosis of bowel cancer. Plaintiff’s decedent consulted with the Defendant physician in August of 2014 after having blood in his stool and low hemoglobin. He continued to have blood in his stool and lost a significant amount of weight by January of 2015 when a video capsule endoscopy was performed. Reports or images related to that study were missing from both the Defendant physician’s and hospital’s records. In June of 2016, a large, ulcerated mass was confirmed to be malignant and had unfortunately metastasized to other parts of his body. He passed away from his disease in September of 2018.
