On October 18, the New Jersey Supreme Court denied the State’s motion to stay same-sex marriages in New Jersey. The Court stated that, because federal agencies did not extend benefits to civil union couples, but only same-sex married couples, civil union couples in New Jersey were not treated equally, and therefore the equal protection clause of the New Jersey Constitution was being violated. After the stay was denied, the State saw the handwriting on the wall and withdrew its appeal of the trial court’s decision to allow same-sex marriages.. Therefore, as of October 21, 2013, same-sex marriages were legal in New Jersey and all of our citizens are being treated equally.
